Lincoln Park Incinerator Class Action Settlement

If you were a resident or are a property owner near the Lincoln Park Incinerator, you may be eligible for benefits from a class action settlement.

Settlement Benefits

The City of Fort Lauderdale has agreed to provide benefits to people who own property or lived near the Lincoln Park Incinerator or were otherwise exposed to the area around the Lincoln Park complex, where levels of arsenic, dioxin, and other environmental contaminants may be elevated. 

Property Damage Payment

Payments up to $750 for current owners of residential property in the Lincoln Park Area of Impact.

Medical Monitoring Program

Access to medical exams and diagnostic testing for diseases associated with exposure to environmental contaminants.

Reserve Fund

You may be entitled to a portion of the $250,000 Bodily Injury Fund if you’ve received a diagnosis associated with exposure to environmental contaminants.

How Do I Know if I’m Part of the Settlement?

Litigation Injury Fund

For named plaintiffs in the litigation who have already filed a claim for personal injuries and/or property damage in Walter Hinton, et al. v. City of Fort Lauderdale, 07-300358 and Ray Adderley, et al. v. City of Fort Lauderdale, CACE11008499.

Property Damage Class

For current owners of residential property located within the Lincoln Park Area of Impact bordered by I-95 to the west, Sunrise Blvd. to the north, NW12th Avenue to the east, and NW 5th Street to the south.

Medical Monitoring Class

For anyone exposed to environmental contaminants from the Lincoln Park Incinerator while living in the Durrs Neighborhood for 10+ years from 1928-present; attending Lincoln Park Elementary School or programs at the school’s facilities from 1960-2003; or playing in Lincoln Park.

Reserve Fund

For anyone in the Property Damage Class or Medical Monitoring Class diagnosed with bodily injury resulting from exposure to environmental contaminants within a year of the effective date of this Settlement.

What’s the Process for My Claim?

Step 1

Complete and submit the two-page registration form online or by mail to the Settlement Administrator at Lincoln Park Complex Settlement, c/o Special Master, 229 South Brevard St., Suite 300, Charlotte, NC 28202. 

Step 2

Get your registration number and claims form from the Settlement Administrator. 

Step 3

Supply additional information and proof of eligibility to the Settlement Administrator.
